Stable Mischief LLC ("Company," "we," "us," or "our") operates kowerk. This policy explains how we handle your personal information.

1. Information We Collect

  • Account Data: Collected via Clerk (name, email, profile photo).
  • Content Data: Messages, uploaded documents, and knowledge base files.
  • Payment Data: Processed via Stripe (we do not store full credit card details).
  • Usage Data: IP addresses, browser types, and interaction logs.

2. How We Use Information

We use your data to:

  • Provide the AI service and maintain your conversation history.
  • Process payments and prevent fraud.
  • Improve platform performance (we do not use your conversation content to train general AI models).

3. AI Data Processing

We use Google's Gemini API. Your messages are sent to Google for processing to generate responses.

  • No Training: Our agreement with Google ensures your data is NOT used to train Google's models.
  • Security: Data is handled under a strict Data Processing Agreement (DPA).

4. Third-Party Providers

We share necessary data with:

  • Clerk (Identity)
  • Stripe (Payments)
  • Google (AI Processing)
  • Sentry (Error Monitoring)

6. Your State Privacy Rights

We comply with the following state laws:

  • Texas Data Privacy and Security Act (TDPSA): Texas residents have the right to access, correct, and delete their data, and to opt-out of targeted advertising or profiling.
  • Tennessee Information Protection Act (TIPA): Tennessee residents have rights to data portability and deletion.
  • California Consumer Privacy Act (CCPA): California residents may request a report of data collected and request its deletion.

7. Security & Biometrics

  • Security: We use TLS encryption and AES-256 data-at-rest encryption.
  • No Biometrics: We do not collect or process "biometric identifiers" (e.g., faceprints or voiceprints) as defined by the Texas CUBI Act or similar laws.

8. Children's Privacy

The Service is not for users under 18. If we discover a minor has provided data, we will delete it immediately.

9. International Transfers

kowerk is operated from the United States. Users outside the U.S. consent to the transfer and processing of data within the U.S.
