Terms of Service

By accessing or using kowerk ("Service"), you agree to be bound by these Terms of Service ("Terms") and our Privacy Policy. You must be at least 18 years old to use this Service. If you are using the Service on behalf of an organization, you represent that you have the authority to bind that organization to these Terms.

kowerk is an AI chat and productivity platform utilizing third-party Large Language Models (LLMs), including Google's Gemini API. The Service includes AI conversations, workspace management, knowledge base storage, and code artifact generation.

You must create an account via our provider (Clerk). You are responsible for all activity under your account. You must notify us immediately of any unauthorized access. We reserve the right to terminate accounts for fraudulent activity or violations of these Terms.

• Billing: Payments are processed via Stripe. By subscribing, you authorize recurring charges.
• Quotas: Usage is subject to plan-specific limits. Exceeding quotas may result in service throttling.
• Refunds: Governed by our Refund Policy.

• Our Property: Stable Mischief retains all rights to the Service's software, design, and branding.
• Your Content: You retain ownership of the data you upload. You grant us a limited license to process this data solely to provide the Service.
• AI-Generated Output: As between you and Stable Mischief, and to the extent permitted by law, Stable Mischief hereby assigns to you all its right, title, and interest in and to the responses generated by the AI based on your prompts ("Output"). You are responsible for ensuring Output does not violate third-party rights.

If you believe that any content within the Service infringes your copyright, please send a notice to our Copyright Agent:

Your notice must include the information required by 17 U.S.C. § 512.

• Accuracy: AI-generated content may be inaccurate, biased, or "hallucinate."
• No Professional Advice: Output is for informational purposes and is not legal, medical, or financial advice.
• Verification: You are solely responsible for verifying the accuracy of Output before use.

You may not: (a) reverse engineer the Service; (b) use the Service for illegal activity or to generate harmful content; (c) scrape or crawl the Service; (d) represent AI-generated content as human-created where disclosure is legally required.

To the maximum extent permitted by law, our total liability for any claim arising out of these Terms shall not exceed the greater of $100 or the amount you paid us in the 12 months preceding the claim. We are not liable for indirect, punitive, or consequential damages.

You agree to indemnify and hold Stable Mischief harmless from any claims, damages, or legal fees arising from your use of the Service, your violation of these Terms, or your Input/Output.

You may cancel at any time. We may suspend or terminate your access for violations of these Terms. Upon termination, your right to access the Service ceases immediately. Data from paused accounts may be deleted after 90 days.

• Informal Resolution: You agree to first attempt to resolve any dispute by contacting support@kowerk.ai.
• Mandatory Arbitration: If informal resolution fails, all disputes shall be resolved through binding arbitration administered by the American Arbitration Association (AAA) under its Consumer Arbitration Rules.
• Class Action Waiver: You agree that any claims will be brought in your individual capacity and not as a plaintiff or class member in any purported class or representative proceeding.
• Venue: Arbitration shall take place in Sumner County, Tennessee, or via remote/video conference.

These Terms are governed by the laws of the State of Tennessee, without regard to conflict of law principles.

We may update these Terms. Material changes will be notified via email or in-app notice. Continued use after an update constitutes acceptance.
